A Canadian Legal Perspective

Competitive bidding has long been a reliable tool for SCM professionals to ascertain market prices and award business. With increasing addressable spend, higher supply volatility, and a desire for greater value creation, there is a greater trend towards negotiations in the procurement process. With the decisions in Tercon Contracting (2010) SCC and Double N Earthmovers (2008) SCC, the Supreme Court of Canada appears prepared to allow some negotiation to occur, provided it is done fairly.

Robert C. Worthington, LLB, is an award winning lecturer and has taught procurement law in Canada for over 26 years. He wrote the only Canadian book on procurement law designed especially for purchasing and contracting professionals, entitled The Purchasing Law Handbook. Robert’s second book, The Public Purchasing Law Handbook, was created especially for procurement professionals working in Government. He is currently writing a new three-volume set due in late 2012. Robert’s keynote presentations are fun and designed to bring you up-to-date on purchasing and contracting affairs.
